On behalf of a client in the manufacturing sector, we intervened against a producer and seller of spare parts whose product listings had the potential to mislead consumers regarding the origin and compatibility of the goods with original systems.

Our work involved issuing pre-litigation cease-and-desist letters and conducting a detailed review of product descriptions on both online marketplaces and the seller’s own website. We flagged the use of product codes and identifiers commonly associated with original parts, which could falsely suggest authenticity. A key issue was the omission of information about the replacement nature of the items at the initial stage of customer interaction.

Following our intervention, the seller agreed to revise the product listings across all sales channels, including their own website. The matter was resolved successfully without the need for court proceedings.
