For a client running an online business focused on collectible items, particularly those whose value hinges on the element of surprise, we developed a solution to tackle return-related abuse. The issue lay in a recurring pattern: consumers would purchase sealed products, open them, keep the most valuable contents, and then demand a refund for what was effectively an incomplete return. In practice, this exposed the seller to predictable losses, turning consumer protection rules into tools for bypassing the principles of fair trade.
Our task was to design a framework that would regulate returns in a transparent and fair way, safeguarding the seller’s legitimate interests while remaining compliant with consumer protection laws. Although the regulations offer no explicit exception in such cases, we identified a legal pathway that allowed the seller to protect their position effectively. The outcome was a return process that curbs abuse, preserves the value of the goods, and brings clarity to both parties, all while respecting the balance between commercial and consumer rights.
