We represented a data controller from the retail sector in a precedent-setting case concerning the right of access under data protection law. The individual requested recordings of customer service calls. Our client provided transcripts of the conversations, maintaining that they sufficiently fulfilled the data subject’s request in light of its stated purpose.

The case escalated to the Polish Data Protection Authority and was later reviewed by the Administrative Court. Our response was supported by foreign case law and opinions from European data protection bodies. Central to our argument was the principle that the data controller may determine the form of access, provided it meets the intended purpose of the request.

The court dismissed the complaint, confirming that the controller had acted lawfully and validating the effectiveness of our legal strategy.
