We provided comprehensive legal support for three international “instant win” marketing campaigns in the FMCG sector. These campaigns, launched simultaneously across several European countries, relied on a mechanism where the prize notification was hidden inside product packaging. In Poland, this approach was classified as a lottery, while in other countries it was deemed a standard promotion outside the scope of gambling regulations.
To ensure compliance, we developed a cohesive legal strategy, drafting separate terms and conditions tailored to the legal frameworks of each country in close collaboration with local law firms. In Poland, a unique challenge arose as the prize was awarded in foreign currency, which required an innovative legal approach to navigate specific tax and gambling laws.
