Complaint to the Office for Personal Data Protection in connection with an alleged breach of personal data protection

What was the problem?

The client operates within a complex capital group. One of the people buying services from a customer filed a complaint to the Office for Personal Data Protection, claiming that there was a breach of the protection of their personal data and a loan fraud. The complaint concerned both the client and another company from the same capital group.

The Office for Personal Data Protection sent a request to the client to respond to the complaint and provide explanations. A standard, very short deadline of only 7 days has been set for this. A similar letter was also received by another company from the capital group, which has never in any way participated in the processing of the data of the person who filed the complaint.

How did we help the client?

Urgently starting the project, we conducted a thorough analysis of how the client processed the data of the person who submitted the complaint. The allegations made in the complaint were unfounded. We have prepared a response to the complaint clearly showing how the client has processed the complainant's data so far and that the complaint is unfounded. We also prepared a response on behalf of the other group company, together with a comprehensive description of the activities carried out by that company, in order to demonstrate that that company did not process the complainant's data in any way and that the proceedings should be discontinued.

What did the client gain?

Thanks to our support, the client was able to quickly respond to the request from the Office for Personal Data Protection. That authority attaches great importance to timely replies to letters on its part and has already penalised a number of operators in the past for failing to cooperate and provide explanations as to how the complainant's data were processed.

The client also received from our side a reliable assessment of the complaint in terms of content. The allegations contained in the complaint, although formulated in a serious manner, in fact proved to be unfounded.
